(THE "SERVICE(S);"), OR BY ELECTRONICALLY ACCEPTING BY CLICKING AN "I ACCEPT" BUTTON OR CHECKBOX IN THE REGISTRATION PAGES OF THE SERVICES, YOU ARE HEREBY AGREEING TO THESE TERMS OF SERVICE (THE "TERMS") AND ANY TERMS INCORPORATED HEREIN BY SPECIFIC REFERENCE.
Client must agree to fully complete the Social Media Marketing New Client Form within 5 days of program start date. This will be to: 1) Establish an overview of your business, management, products & services and unique value to the marketplace. 2) Diagnose your current Social Media situation. Ongoing communication between you (or your contact) and THE CUMMINGS GROUP INC associate will be priority. This will be necessary to make adjustments, specify details, answer questions, modify curriculums etc.
Client will need to provide:
+ Completed Business Profile for set ups and communication preferences. (need an email and internet connection to accept delivery of curriculums)
+ Attendance of all social media webinars or recordings where applicable.
+Timely communication and responses when working with THE CUMMINGS GROUP INCÕs staff to avoid delays in your Social Media learning.
Client must be timely and proactive in the actionable strategies or tactics needing to be implemented as agreed upon by both parties.
Client may relieve THE CUMMINGS GROUP INC of our services if we are found to be operating unethically, maliciously, with fraud or with dishonor to client.
THE CUMMINGS GROUP INC may relieve client of our services if client is found to be operating unethically,, maliciously, with fraud or with dishonor towards THE CUMMINGS GROUP INC or clientÕs customers.
Our business operates under a strict guideline of moral ethics, and the same is expected by our client concerning our business relationship.
Any sensitive figures, data, sales projections, budgets amounts, sales reports, etc obtained by THE CUMMINGS GROUP INC. will remain confidential and will not be shared with anyone outside your company. Sensitive information will only be discussed with our contact person(s) listed inside this contract. Confidentially includes delivery of service. We will not publish or advertise the fact we are operating as your Social Media partner Š unless you give us written permission to do so.
Strategies and techniques used by THE CUMMINGS GROUP INC to create, grow and implement the Social Media Marketing services will be communicated in advance via phone conversation or email upon initial registration. The specific details of services provided for your Social Media Marketing program are specified on our website at: www.thecummingsgroup.com under the services tab. Phase One, Initial Setup for your Social Media Webinars begins within 2 business days of your completing the Strategy/Intake phone consultation or online registration.
At the end of every 30-day period you will receive a Monthly Progress Report that highlights the major work accomplished. This will be submitted to you via e-mail.
Our services are contracted for only one business per contract. If you own/run multiple businesses, we will perform our services for one business entity. In the event you are a parent company, one legal business entity will need to be assigned for our services. Otherwise, additional monthly fees and service agreements will be required for additional businesses.
You agree that your subscription for our Social Media webinars is a onetime charge collected upon registration for the class.
If after three Social Media Webinars, you are not completely satisfied with your services given on our Social Media webinar program, you may cancel by notifying us in writing by sending us your request via email to billing@thecummingsgroup.com.
There is no refunds available for our products and services as there is nothing returnable and extensive course planning and curriculums have been developed for this program.
THE CUMMINGS GROUP INC. reserves the right to modify these Terms from time to time. The modified terms will be posted on this page. You should check here from time to time for updates. You agree that your use of the Services after such a change will be deemed full and adequate acceptance of the modified Terms. THE CUMMINGS GROUP INC. also reserves the right to modify, discontinue or make temporarily unavailable the Services and that any new or modified features, unless explicitly stated otherwise are subject to these Terms.
You acknowledge that these Terms with the included Privacy Statement constitute the entire agreement between you and THE CUMMINGS GROUP INC. You agree that these terms supersede any prior agreements or statements made verbally or in writing.
You agree that if any term in this agreement is deemed to be invalid, unlawful or unenforceable for any reason, all other terms shall remain in force.
These Terms will be governed by Oregon and United States law.
You agree that this agreement shall remain in effect for as long as you subscribe to, renew, or use the Services. You agree that this agreement can only be terminated by you once you have stopped using the Services and have paid all monies owed to THE CUMMINGS GROUP INC. You agree that THE CUMMINGS GROUP can terminate this agreement at any time for any reason, with or without cause, if it has reason to believe that you are violating the Terms in any way, or when the Service is permanently discontinued. Re-subscription shall again be subject to these or modified Terms in effect at the time of re-subscription.
